It may not have been a spur of the moment thing, but it was stupid. You do not co-sign for anyone unless you are married to that person. An engagement is nothing. You are liable for this loan. He won’t refinance because he can’t. If he had good enough credit, you would not have had to co-sign. No finance company will take your name off the note. They don’t care about you and your situation, they just want their money. Tough. The courts won’t do anything either.

I’d take him to small claims court. If he’s got the vehicle then he needs to make te payments. Never know the judge may make him give it to you!

You may have to bring him to small claims, but since nothing is actually due, I don’t know what to tell you. Pretty much you are stuck in it unless he refinances. Now, keep in mind as you are on the loan, if he defaults you can take the car and take over the payments and he can’t stop you.

I’d go to the bank loan department first, and let them know what’s happening. It may or may not be a first step to solving the issue. Maybe they would have some advice, as well.
Next, i’d let him know he will have to go to court for this if he doesn’t refinance the vehicle. If a threat doesn’t work, then do take him to court. You shouldn’t have to have bad credit just because the relationship broke up.

Yes, you can take him to court. Go to your local court office and ask about civil court and explain what you want to do to do the clerk. he/she will guide you somewhat on the paperwork…. you pay a small fee to have your case heard. Be prepared with the documents of the terms, bring proof of late payment from the financer, bring a copy of your most recent credit rating report (you can get that online, for a fee of course) and when you file your claim against your ex you ask for your name off of the loan, all expenses incurred to take him to court (court filing fees, credit report fees and any other fee) In court be professional, organized and always address the courts in a formal manner your honor. Dont let your ex get you riled up…. judges hate that.. just present the facts. You need to do this asap before your credit is ruined to the point you will never get your own loans or even be able to rent a place in the future.
