Is bankruptcy the best solution?
Haunted asked:
After having been wrongfully terminated August of last year, and being out of work for nearly 4 months with no income, my car was repossessed. On top of owing close to $15,000 for that, I owe for a cell phone bill, as well as 4 credit cards, one of which I got to help out while I was out of work. Are there any other options to get myself out of debt without spending years and more money than actually owed to avoid filing bankruptcy? Some of these credit cards have gone up 4 times the amount that was initially owed. One of my major concerns is that I was paying the payment protection plan and none of the companies honored it. I would have easily been able to pay my debt had they honored the payment protection plan. I could dispute that and get the amount owed down to the actual amount, but where does that leave me with paying off a car I don’t have? Please, any advice would be greatly appreciated. I’m only 26 and the last thing I want to do is file bankruptcy.
I’m furthering my education and do not wish to have such poor credit for the next 7 years. How will I be able to afford rent, a car, and paying this debt off while going to school?

Should I pay a few creditors and not one of them?
ocmike asked:
I owe 4 different creditors money but it is becoming difficult to pay them all at one time (each month). Should I pay the ones that I can and stop paying one of them and let it go to collections; hoping that I can settle that one account? Thus, avoiding bankruptcy and avoiding credit counseling that I hear does not work.

How can bankruptcy be avoided?
Wheep Wheep Piggy Feet asked:
Assuming you already have some debts?
I don’t mean outrageously high debt… I’m saying some credit card debt, and some student loan debt.
I understand that bankruptcy is for people who are unable to pay their debts. I get that. What I want to know is how to avoid having to file bankruptcy if you have debts but are struggling to pay them.
Here’s the situation… I have been sub teaching but it just isn’t paying enough anymore, and it never really did. I have a little bit of money saved up, not much. I have some credit card and student loan debt left over from when I was in college. I don’t have heavy financial expenses but my bills are around $300-ish a month.
Anyway, I HAVE to find another job because I’m not making nearly enough. What worries me is that that could take really long! It scares me that I’ll be searching indefinitely. I have something lined up next week, but it’s just temporary (it lasts a couple months at most).
All this stuff I read about how everyone is a paycheck away from bankruptcy and all this stuff that implies that job loss means that bankruptcy is just a matter of time… freaks me out. I don’t know how much of this stuff to believe.
How can bankruptcy be avoided in this situation? I understand not to spend money on stuff you don’t need, but I already have some debts. I don’t want my credit, possibly life, to be ruined.
Futhermore I understand that bankruptcy stays on your credit for 7-10 years.
I don’t even know if you can get student loans if you’ve declared bankruptcy?
I know that you still have to PAY them, but are you eligible for more?
I’m not thinking of declaring bankruptcy at all… I know that it’s something you do as a last resort. I just want to know how to avoid it!
Thanks if you can help me.
If you have a mean answer, then you are not welcome and you can leave.

I’ve avoided it for as long as I could but I have to file for chapter 7. I have talked to a lawyer and the fee was $1500 from them plus the $249 filing fee for the bankruptcy.

collection agencies: how to tell whether it’s assigned debt or bought from original creditor?
J H asked:
if it’s asigned does that mean the offer to settle should go to the original creditor (ie Amex)? by the way debt is from business necessities, and business has been gotten out of–debt was unavoidable and not based on spending habits. trying to avoid bankruptcy and pay off. do they sometimes settle for payments or do they only want lump sum?
