Should I tell creditors that I’m filing for bankruptcy?
txmiraclebabies asked:
I am waiting for my attorney to file my bankruptcy request. But in the meantime, I’m getting collection calls from NCO Financial literally every 5 minutes! They have even started calling my parent’s home which I haven’t live in for almost 20 years! They are in their late 80’s and can’t handle the constant calling!
Should I just tell the company that I am filing for bankruptcy? How can that work against me? Or should I just keep avoiding their calls?

How to I file a claim for reimbursement against a company that filed bankruptcy?
HooHoo asked:
Today I called about my gift card for Bennigan’s and I received the following message.
SA Restaurant Corp. and certain affiliates have filed for bankruptcy under Chapter 7 of the bankruptcy code. The companies that filed bankruptcy cases are popularly known as Steak Ale, Bennigan’s and Tavern restaurants. However, not all stores using these trade names have filed bankruptcy. For example, stores operated by franchisees are not named as debtors in these filings.
It is our understanding the Michelle Chow will be appointed as Chapter 7 trustee for the entities that have filed. These are filed as liquidation cases. Future decisions regarding the affairs of the debtor companies will be determined and administered by the trustee.
If you wish to file a claim, the form Proof of Claim can be found online at: http://www.uscourts.gov/rules/BK_Forms_1207/B_010_1207f.pdf.
The filing does not include Ponderosa and Bonanza which operate under Metromedia Steakhouses Company, L.P.
My question is…
How do I file a claim? (There are many terms and questions on the form that I am not familiar with and I would love to see an example of a completed form.)

Can a collection agency call after you have given them your bankruptcy attorney’s number?
Lemondrop asked:
I received a phone call from a collection agency about a month ago, Tibouron Financial to be exact. I told them very nicely that I had retained a bankruptcy attorney and gave them his name and number. They have called me twice today, and everytime they have called, I would answer the phone on the second ring and there would be a dial tone. Also I should add that this was 7:30 at night. What should I do?

How does a chapter 13 buyout mortgage work?
tkwiley44 asked:
We are in Chapter 13 bankruptcy, but have paid it down to less than $10,000. We can have a lower mortgage payment if we refinance and pay off the Ch. 13. Is this a good thing to do?

Just thinking outside of the box here: What about a homeowner bailout?
Tones asked:
Here’s what I propose: Have the government bailout the mortgage companies by purchasing their bad debt at a 20% discount and then re-negotiate the loans with the consumer to pay the balance a 0% interest over 50 years with no early payment penalty? If the consumer defaults payments on that generous deal, the government takes possession of the property and sells the property on the open market. That way, the banks get liquidity and their costs decrease in that they don’t have to waste money sending default notices, etc., the homeowner is happy because they get to stay in the house and actually might be able to afford the house which they were erroneously advise they could afford by realtors when they couldn’t. The government is happy because they’d be receiving cash when normally, typical government spending is even less profitable (look at the price paid by governments for toilet seats).
Quite possibly, the only unhappy people would be attorney’s because no one would be able to afford one. I’m all for keeping attorneys being miserable. Would you buy this investment? What other solutions might there be given that declaring random wars on countries doesn’t seem to have work in USA’s current political administration?
